Copyright takedown and counter-notice procedure under 17 USC §512.

If you believe content on Locasity infringes your copyright

Send a written notice that includes all of the following (17 USC §512(c)(3)):

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works at this site are covered by a single notice).
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to let us locate it — for content on Locasity, that means the full URL of the page or asset.
  4. Information reasonably sufficient to let us contact you: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.

Notices that omit any of the above may not qualify under the DMCA and we may not be able to act on them.

Counter-notice

If your content was removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice with the following (17 USC §512(g)(3)):

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number; a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Locasity may be found); and a statement that you will accept service of process from the person who provided the original DMCA notice.

On receipt of a valid counter-notice we may restore the content after 10–14 business days unless the original complainant files an action seeking a court order against you.

Repeat infringers

Per 17 USC §512(i), Locasity terminates accounts of users determined to be repeat infringers in appropriate circumstances.
